In the name of God Amen I Mary Broughton of Hatton Garden in the County of Middlesex Widow do make this my last will and Testament in manner following that is to say

Aas to my funeral I leave the same to the discretion of my Executors desiring the same may be done in a decent manner and the charges thereof not to exceed the sume of one hundred pounds

And as to my worldy Estate I do hereby give and bequeath all my Capital Stock and Annuity stock in the South Sea Company Bank of England East India Company and other companyes and my money owing to me upon mortgaged bonds bills notes debts due and oweing upon Simple contract and other securitys and all my Goods Chattells and Personal Estate whatsoever unto William Winde of Brookstreet Grosvenor Square Esq. Exton Sayer Doctor of laws and Charles Bayliffe of the Chancery Office Gentleman their Executors Administrators and Assigns upon the Trusts and for the purposes hereinafter mentioned that is to say

Uupon trust that my said Trustees do and shall dispose of and apply one moyety of all the said Trust Estate and of the Interest Dividends and profits thereof unto and for the sole and separate use and disposal of my Daughter Mary Strudwick during her natural life Exclusive of her present or any other husband and with which such her husband shall on no sort intermeddle neither shall the same be subject to his debts or Engagements

And after her decease then upon trust that they the said trustees do and shall dispose of and apply the said Moyety of the said trust Estates unto and amongst such of the children of her my said Daughter Mary Strudwick in such proportions and at such times as she my said Daughter Mary Strudwick by any writing or Writings under her hand and seal attested by two or more credible witnesses or by her last will and testament in writing or any writing purporting to be her last will and testament attested to as aforesaid shall by herself alone and seperately without her husband direct and appoint and for want of such direction or appointment then unto and amongst all and every such child and children of my said daughter mary strudwick equally share and share alike and to be payable to such of them as shall be sons at their respective ages of one and twenty years and to such of them as shall be daughters at their respective ages of twenty one years and then as they deserve it by being dutyfull to their Mother

And if any of such sons shall dye before his age of twentyone years leaving issue then such issue shall have his or her fathers share thereof and if any of such children shall dye before his or her share of the said trust Estate shall become due or payable then such his or her part or share of the said trust estate shall go and be payable to the survivor or survivors of them in the same manner as their respective shares are to go and be payable

And for want of such child or children then my trustees shall dispose and apply the said moyety of the trust Estate unto such persons or person and for such estates interstes or purposes as my said Daughter Mary Strudwick by any writing or Writings under her hand and seal attested by two or more credible witnesses or by her last will and testament in writing or any writing purporting to be her last will and testament attested to as aforesaid shall by herself alone and seperately without her husband direct and appoint

And for want of such direction or appointment then upon trust that the said moyety of the said Trust Estate shall go as unto and be enjoyed by my other daughter Theodesia Broughton her heires executors administrators and or asigns forever

And my mind and will is that my said trustees shall dispose and apply the other moyety of the said trust Estate to and for the benefit of my said other daughter Theodesia Broughton her heirs Executors and administrators forever

And I give and devise unto my said trustees the said William Winde Exton Sayers and Charles bayliffe their heirs and asigns for ever all my reall estate consisting of Messuages Landes Tenements and hereditaments situate lying and being in the Realm of England or in the island or Plantations of jamaica or Elsewhere in the world upon trust that they my said trustees shall convey and settle the same to the same uses and upon the trusts and for the same purposes as i have herein before directed of and concerning my said Stocks and personal Estate herewith before mentioned by the advice of council or as near the same may be done by law

And I do hereby make and appoint the said William Winde Exton Sayers and Charles bayliffe to be Executors of this my last will and testament In trust for the purposes aforesaid

And i doe hereby give unto my said trustees the sume of fifty pounds apeice towards satisfaction for their trouble in the execution of this my will or the trusts therein mentioned

And my will is that all the Costs and charges and Expenses which my said Trustees shall be at in the execution of this my will shall be born and paid out if the said trust estate

And my will is that my said Trustess shall not be answerable or responsible the one for the other or for the act or acts receipt or receipts the one for the other

And i do hereby revoke all former wills by me made and subscribed and I do declare this to be my last will and testament this first day of January in the year of our Lord One thousand Seven Hundred and twenty in the presence of the subscribed Mary Broughton
