This is the last will and testament of me Frances Strudwick of Stoke next Guildford in the County of Surry widow first I direct all my just debts funeral and testamentary expenses to be fully paid satisfied and discharged as sonn as can be after my decease by and out of my personal estate
Also I give and bequeath to my neice Frances Browne the elder all my wearing apparel of every sort and kind to and for her own absolute use and benefit whereas my late husband John Strudwick made and duly signed and published his last will and testament in writing bearing date on or about the twenty fourth day of September One Thousand eight hundred and fourteen
And hereby after directing the payment of his debts and funeral and testamentary expenses gave and bequeathed in the words or to the purport and effect following :
” also subject as aforesaid, I give and bequeath all and every my goods, Chattells, credits, ready money and personal estate, whatsoever and wheresoever, which I shall die possessed of or entitled to, unto my brother John Lamboll of Stoke next Guildford aforesaid, Victualler, and John Moore of Stoke next Guildford aforesaid, Baker, their executors and administrators, upon the trusts and for the uses intents and purposes following
(that is to say) upon trust that they or the survivor of them, his executors or administrators, do and shall pay and apply, permit and suffer my dear wife Frances to have, receive and take, to and for her own benefit, the use, dividends, interest and produce of all and every my said Goods, chattells, credits, ready money and personal estate, whatsoever and wheresoever, for and during the term of her natural life,
and from and immediately after her decease, then as to one moity or equall half part of all my said goods, chattells, credits, ready money and personal estate, do and shall pay and apply the same unto and for the use of such person or persons, and in such parts or shares and proportions, as my said wife in her lifetime shall by any deed or Instrument in writing, or by her last will and testament limit or appoint the same to be paid and applied
and in want of such direction, limitation or appointment, do and shall immediately, on the death of my said wife, pay and apply such the said moity of my said personal estate unto such person or persons as might then be the next of kin and in the same manner as is previously bequeathed and direct to be paid to the parties aforesaid accordingly
And as for and concerning the remaining moity or equal part of my said personal estate upon trust that my said trustees or the survivor of them, do and shall pay and apply the same, immediately on the death of my said wife, unto and amongst all and every the child or children of my brothers and sisters, to be divided amongst the survivor or survivors of my family, Thomas Strudwick, Mary Marshall, Sarah Sterne, and Elizabeth White, shall be living at the decease of my said wife, equally to be divided amongst such children last aforesaid (if more than one alive) share and share alike, and if but one alive then the whole to be paid to such one child
and while I do hereby give and bequeath to, and direct to be paid and applied accordingly, also (subject as herein before mentioned) I give and devise unto, and to the use of, my said wife Frances Strudwick and her assigns, for and during the term of her natural life, all and every my messuages, lands, tenements, hereditaments and real estate, with their appurtenances, situate and being in the parish of Stoke next Guildford aforesaid or elsewhere in Great Britain
and from and immediately after her death, I give and devise all and every my said messuages lands tenements hereditaments and real estate, with their appurtenances, unto the said Thomas Strudwick and Thomas Lamboll their heirs assigns for ever, upon the special trust and confidence nevertheless, that they or the survivor of them or the heirs and assigns of such survivor, do and shall immediately on the death of my said wife, sell and dispose of and convey all and every my said messuages lands tenements hereditaments and real estate with their appurtenances, either by public auction or private contract (as to my said trustees shall so make), unto any person or persons desirous of purchasing the same for the most money and best price that can be obtained for the same
and as for and concerning the money to arise and be received by such sale do and shall immediately thereupon ( after payment thereof of such part of my just debts funeral expenses and the expenses of proving this my will, as my personal estate shall be insufficient to pay if so deficient, and the expenses of such sale and of the trusts hereby in my said trustees respectively reposed and other incidental expenses, and further concerning the summ of five pounds apeice of lawfull money which I do hereby bequeath to them) pay and apply in equal moieties the whole residue thereof unto such person or persons and in such shares and proportions respectively as my said personal estate herein before mentions (after the death of my said wife) is directed to be paid and applied and which I do hereby give and bequeath and direct to be paid and applied accordingly and I do hereby nominate and appoint the said John Lympose and John Moore Executors of this my will”
And whereas the said John Strudwick departed this life on the twenty seventh day of November now last past and the said will has since been duly proved by the executors thereof in the prerogative court of Canterbury now I the said Frances Strudwick do hereby in pursuance of every power or authority given or trusted to me in and by the herebefore in part recited will of my said late husband deceased direct limit and appoint and also give and bequeath all and singular the said monies affects and premises so as aforesaid vested in me in and by the last will and testament of my said late husband John Strudwick deceased and in or over which I have any power of appointment unto my nephews and neice the said Frances Browne the elder Charles oakley Senior John Pitcher? and my great Nephews and neices Charles Oakley Junior William Work James Browne Frances Browne junior Thomas Browne and Ann Browne equally to be divided between them share and share alike as tenants in common and not as joint tenants and to their respective executors administrators and assigns absolutely and for ever
and I hereby nominate constitute and appoint John Carpenter of Stoke aforesaid Coach Maker and John Moore of the same place Garddier? Executors of this my will
and I direct that they my said executors and the survivor of them the executors administrators and assigns shall be fully authorised to give receipts for all monies payable to them under and by virtue of this my will and that such receipts shall be a sufficient discharge to the application or be answerable or accountable for the nonapplication or misapplication thereof or any part thereof
and I do hereby authorize and empower them and the survivor of them his executors and administrators to retain to reimburse to themselves and to pay over to each other all such rents charges and expenses and reasonable allowance for such time and trouble as they shall respectively sustain incur or be put unto in or about the probate of this my will or on execution thereof
and do hereby direct that they or either of them shall not be answerable or accountable for any more of the said trust monies than shall actually come to their respective hands nor for the failure of any banker or broker or otherwise except the same shall happen by or through their respective wilfull neglect or default nor one for the other of them (notwithstanding their joining in any receipt for conformity only) but each of them for himself and his own acts neglects and defaults only
in witness whereof I the said Frances Strudwick the testatrix have to this my last will and testament contained in four sheets of paper to the first three sheets thereof set my hand and to the fourth and last sheet my hand and seal the twenty second day of December One thousand eight hundred and twenty nine Frances Strudwicke

Proved at London 24th August 1830 before the Judge by the oath of John Carpenter and John Moore the executors to whom admon was granted being first sworn duly to admin.
